Welcome to Ideal Health And Fit. These Terms and Conditions ("Terms") govern your use of our website (idealhealthandfit.com), mobile application, and all healthcare, wellness, and insurance services provided by Ideal Health And Fit and its affiliates. By accessing or using our services, you agree to be bound by these Terms.

1. Service Usage

1.1 Eligibility: You must be at least 18 years of age (or accompanied by a legal guardian for minors) to use our services. You must be a resident of the United States or its territories.

1.2 Account Registration: You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

1.3 Permitted Use: Our services are intended for legitimate healthcare and wellness purposes. You agree not to use the platform for any unlawful purpose, including but not limited to fraud, harassment, solicitation, or obtaining prescriptions through deception.

1.4 Telehealth Acknowledgment: Telehealth services are not a substitute for in-person emergency care. If you are experiencing a medical emergency, call 911 immediately. Telehealth consultations may not be appropriate for all conditions, and our providers reserve the right to recommend in-person evaluation.

1.5 Scope of Services: Ideal Health And Fit provides healthcare coordination, access to licensed providers, wellness programs, and insurance brokerage services. We do not guarantee specific health outcomes. Individual results vary based on numerous factors.

2. Payments and Billing

2.1 Service Fees: All fees for services are listed on our website and confirmed at the time of booking. Fees are subject to change with 30 days' notice. Existing appointments will be honored at the originally quoted rate.

2.2 Insurance Copayments: If you are using insurance, your copayment, coinsurance, and deductible amounts are determined by your insurance plan, not by Ideal Health And Fit. We collect these amounts at the time of service.

2.3 Self-Pay: For uninsured patients, full payment is due at the time of service unless a payment plan has been pre-approved in writing. Payment plans require a minimum balance of $500 and are subject to credit assessment.

2.4 Payment Methods: We accept Visa, Mastercard, American Express, Discover, HSA/FSA cards, ACH bank transfers, and Apple Pay/Google Pay. All payments are processed through our PCI-DSS Level 1 compliant payment gateway.

2.5 Outstanding Balances: Balances not paid within 30 days of the due date may be subject to a late fee of 1.5% per month (18% annually). We may refer delinquent accounts to a collection agency, which may affect your credit score.

2.6 Refunds: Refund requests must be submitted within 14 days of the service date. Refunds for services already rendered are evaluated on a case-by-case basis. Processing takes 7–10 business days.

3. Insurance Services

3.1 Brokerage Disclosure: Ideal Health And Fit acts as a licensed insurance broker/agent for health and life insurance products. We are not the insurer. Insurance products are offered through affiliated carriers, and coverage is subject to the terms of the individual insurance policy.

3.2 Plan Recommendations: Our insurance recommendations are based on the information you provide and are meant to assist your decision-making. We strongly recommend reviewing all plan documents carefully before enrollment.

3.3 Enrollment: Insurance enrollment through Ideal Health And Fit is subject to carrier approval, open enrollment periods, and qualifying life events. We do not guarantee enrollment approval by any insurance carrier.

3.4 Commission Disclosure: Ideal Health And Fit receives compensation from insurance carriers for policies sold through our platform. This compensation does not affect the premium you pay and is standard industry practice.

4. Liability Limitations

4.1 Medical Disclaimer: The information provided on our platform is for general informational purposes and does not constitute medical advice. Always consult with a qualified healthcare provider for medical decisions.

4.2 Limitation of Liability: To the maximum extent permitted by law, Ideal Health And Fit's total liability for any claim arising from or related to our services shall not exceed the total amount you paid to Ideal Health And Fit in the 12 months preceding the claim.

4.3 Indemnification: You agree to indemnify and hold harmless Ideal Health And Fit, its officers, directors, employees, and affiliates from any claims, damages, losses, or expenses arising from your violation of these Terms or your use of our services.

4.4 Provider Independence: Healthcare providers on our platform are independent practitioners. Ideal Health And Fit is not liable for the medical advice, diagnosis, or treatment provided by these independent providers.

4.5 Technology Limitations: We are not liable for service interruptions, internet connectivity issues, device compatibility problems, or data loss caused by factors beyond our reasonable control.

5. Cancellation Policy

5.1 Patient Cancellations: Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled time. Cancellations within 24 hours incur a $25 fee. No-shows are charged the full consultation fee.

5.2 Provider Cancellations: If a provider cancels an appointment, we will notify you immediately and offer a rescheduled appointment at your convenience or a full refund.

5.3 Insurance Plan Cancellations: Insurance policy cancellations are governed by the terms of the specific insurance policy and applicable state laws. Contact our insurance team for assistance with policy cancellations during the appropriate window.

5.4 Subscription Cancellations: Wellness program subscriptions may be cancelled at any time. You will retain access until the end of your current billing period. No prorated refunds are provided for partial months.

5.5 Emergency Exceptions: Cancellation fees are waived for documented medical emergencies, severe weather events, and other circumstances beyond your control. Documentation may be required.

6. Intellectual Property

6.1 Ownership: All content, branding, logos, design elements, software, and proprietary technology on the Ideal Health And Fit platform are owned by Ideal Health And Fit and protected by US and international intellectual property laws.

6.2 Restricted Use: You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any content from our platform without prior written consent.

7. Dispute Resolution

7.1 Informal Resolution: You agree to first attempt to resolve any dispute with us by contacting our support team. Most issues can be resolved within 30 days.

7.2 Arbitration: Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in USA.

7.3 Class Action Waiver: You agree to resolve disputes individually and waive any right to bring or participate in class actions, collective actions, or representative proceedings.

8. General Provisions

8.1 Governing Law: These Terms are governed by the laws of the State of USA, without regard to conflict of law principles.

8.2 Severability: If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

8.3 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ideal Health And Fit regarding the use of our services.
